Advertising Terms and Conditions

Placement of advertising is entirely at the discretion of the Editor or Advertising Manager, except where otherwise arranged, and agreed to in writing. Essence Magazine reserves the right to cancel, suspend or reposition any advertising.
All orders, cancellations, alterations and instructions should be made in writing. No responsibility will be taken for errors or omissions caused by misinterpretation or oversight in verbal communications or instructions. Late cancellation of advertising space will result in a penalty payment by the client and/or the advertising agency. Advertisers and/or their advertising agencies are jointly liable for prompt payment for any advertising and/or production costs.
The advertiser guarantees that the advertising matter submitted for publication:
a) contains no false or unwanted claims for any product or service;
b) contains no defamatory statements or matter;
c) does not infringe the copyright, privacy or other rights of any person or organisation, of the Fair Trading Act, 1986;
d) may be published without the Publisher incurring any liability of any nature whatsoever.
The Publisher reserves the right to alter, abbreviate or decline to publish an advertisement that, in the Publisher’s opinion or the opinion of the Advertising Manager, is unacceptable for any reason whatsoever.
The Publisher of essence magazine will not be held responsible for non insertion for any reason beyond the Publisher’s control. No liability will be accepted for any loss caused by the failure of advertisements inserts to appear.
Accounts for advertising space and production are due for payment on the 20th of the month following invoice date. Accounts overdue after this date will carry an interest charge of 2.5% per month or part thereof.
If payment of the account for publishing advertising is not made by the due date the advertiser may be liable for all costs of recovery and collection fees.
ARTWORK: Unless specifically agreed with the advertiser at the time of submission, the company does not undertake to return artwork, nor does it accept any responsibility with regard to accidental damage or loss of drawings or other material supplied for the purpose of an advertisement. The artistic copyright of all advertisements designed by essence magazine is the property of essence magazine and reproduction in other publications without permission of essence magazine is not permitted.
